Terms of Use

Introduction

These Terms of Use (the “Terms”) constitute a legally binding agreement between Spaace Agency (the “Company”, “we”, “us”, or “our”) and the user (“you” or the “User”).

The Company provides an online platform through its website and mobile application (the “Platform”) that connects people offering various experiences (“Experience Providers”) with people who wish to book those experiences (“Users”).

The Platform serves solely as an informational and communication intermediary. The Company is not a travel agency, tour operator, or tour guide and does not create, control, organise, or provide any experiences.

1. Using the Platform and booking

• Browsing: Users may browse available experiences without registering.
• Registration and authentication: To submit a booking request, a User must create an account. Users may register using the standard email form or an integrated third-party single sign-on (SSO) service, such as “Sign in with Google”. Users of external services must also comply with those services’ terms of use.
• Essential electronic communication: By registering an account, the User expressly agrees to receive transactional emails (such as booking-request status updates) and notices essential to the Platform’s operation.
• Request acceptance: After a User submits a request, the Experience Provider may accept or reject it at its discretion.
• Internal communication: Further organisational communication takes place exclusively between the User and Experience Provider through the Platform’s encrypted chat system.

2. Prices and payments

• Indicative prices (estimates): All experience prices displayed on the Platform are informational estimates only. The Company does not take part in collecting payments. The final price, payment method, and cancellation terms (described further in the Cancellation Policy) are matters for direct agreement solely between the User and Experience Provider.
• For Experience Providers: The Platform operates on a subscription model. It does not charge commissions on bookings.
• For Users (Tourists): The Platform does not intermediate financial transactions. All payments are made directly to the Experience Provider.

3. Taxes

Experience Providers are fully and solely responsible for declaring and paying all applicable local, national, and international taxes. The Company disclaims any responsibility for the Experience Providers’ tax obligations.

4. Content and third-party services

• Ownership and responsibility: A person who uploads Content (photographs or text) retains all copyright and assumes full financial and legal responsibility for any infringement of third-party copyright.
• Third-party integrations: The Platform uses external interfaces, including Google Places API and Google Vision API. By using the Platform, you agree to the binding terms of those services.
• Marketing licence: By uploading Content, users grant the Company a free, perpetual licence to use it for promotional purposes.

5. Liability

The Company is not responsible for injuries, damage, accidents, the quality of experiences, cancellations, or financial disputes between Users and Experience Providers. Users participate in experiences at their own risk.

6. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia. The parties will first seek to resolve any dispute amicably. If no agreement is reached within 30 days, the court of competent subject-matter jurisdiction in Niš shall have exclusive jurisdiction.
